FRE x PBR Ticket Sweepstakes Terms and Conditions

By participating in the FRE x PBR Ticket Sweepstakes (“Sweepstakes”) offered by National Tobacco Company, L.P. (“FRE”), you (“Participant”) agree to the following terms and conditions:

1.) Eligibility and How to Enter

To participate, you must:

a)    Be at least 21 years of age at the time of entry.

b)    Be a legal resident of the United States.

c)     Enter the Sweepstakes by scanning a QR code and completing the online entry form at:  https://frepouch.com/pages/pbr-ticket-giveaway

d)    Follow one or more FRE social media pages (@frepouch).

e)    The Sweepstakes begins at [Start Time and Date] and ends at [End Time and Date] (“Entry Period”). Entries submitted before or after the Entry Period will not be eligible.

f)     Limit one (1) entry per person. Multiple entries from the same person will result in disqualification.

g)    Winners will be selected through a random drawing from all eligible entries received during the Entry Period. Drawings will be conducted at least one (1) week prior to each event date.

h)    Winners will be notified via [email] within seven (7) days prior to each event. Potential winners must respond within forty-eight (48) hours to confirm acceptance and claim the prize. If no response is received within that time, an alternate winner may be selected. FRE is not responsible for any failed or undelivered winner notifications.

2. Prize

·      Each winner of the Sweepstakes will receive a total of four (4) single-day tickets to a Professional Bull Riders (PBR) event. Tickets are valid only for the specific event date selected by the Participant at the time of entry and cannot be used for multiple days or as a weekend pass.

·      A maximum of four (4) single-day tickets will be awarded per Sweepstakes winner, per event. Tickets are only valid for the date the winner selects during the entry process and may not be transferred to a different date after submission.

·      Each ticket has an approximate retail value of $300 USD, subject to change depending on the event. Tickets have no cash value and may not be redeemed for cash or exchanged for credit.

·      The Sweepstakes prize includes event admission only. It does not cover travel, lodging, meals, beverages, parking, or any other incidental costs related to attending the event. All taxes and additional expenses associated with receipt, use, or enjoyment of the prize are the sole responsibility of the winner.

3. Consent to Use of Image and Content and Privacy Disclosure

·      By entering the Sweepstakes, you grant Professional Bull Riders, LLC and National Tobacco Company, L.P., as well as their affiliates, licensees, and agents the right to use your name, likeness, social media posts, and image in connection with marketing, advertising, promotion, publicity, or other commercial purposes in perpetuity, worldwide, and in any media now known or later developed, without further compensation, notice, or approval.

·      By entering the Sweepstakes, you consent to the collection, use, and disclosure of your personal data by FRE for the purposes of administering the Sweepstakes, verifying age and identity, announcing winners, and for marketing and promotional purposes, subject to the FRE’s Privacy Policy which is available at: https://frepouch.com/pages/privacy-policy.

·      Your personal data may be shared with PBR and third-party service providers engaged by FRE to administer the Sweepstakes and deliver prizes. You may withdraw your consent at any time by contacting info@frepouch.com.

4. Release of Liability

·      By participating in the Sweepstakes, you agree to release and hold harmless National Tobacco Company, L.P., Turning Point Brands, Inc., Professional Bull Riders, LLC, and their affiliates, officers, employees, and agents from any and all claims, damages, liabilities, costs, or expenses arising out of or related to your participation in the Sweepstakes or attendance at PBR events.

5. Additional Terms

·      Prior to awarding or shipping any prize, all participants must undergo age verification to confirm eligibility. Failure by you to provide valid proof of legal age will result in disqualification and forfeiture of the prize.

·      FRE reserves the right to deny entry, disqualify participants, or revoke tickets for any reason.

·      Sweepstakes void in states and jurisdictions where prohibited.

·      FRE reserves the right to cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or any other factor beyond FRE’s reasonable control impairs the integrity of the Sweepstakes, as determined by FRE in its sole discretion.

·      Under no circumstances shall Participant be considered an employee. This Sweepstakes shall not be construed to create any association, partnership, joint venture, employment, or agency relationship between you and the Company for any purpose. You have no authority (and shall not hold yourself out as having authority) to bind the Company and you shall not make any agreements or representations on the Company's behalf without the Company's prior written consent.

·      Any controversy or claim arising out of or relating to this Sweepstakes, contract, or the breach thereof, shall be settled confidentially by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

·      This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky.
